The extended collective licence system. The systems is based on the existence of collective organisations representing the rightsholders. On behalf of their members the collective organisations enter into agreements with users of copyright protected works within certain areas.

REPROGRAPHIC LICENCES - Types of works licensed
All types of published material except audio visual works and pictorial art which does not appear in a textual context.
Types of uses licensed
Licensing for educational purposes includes photocopying, reproduction of works in digital form (e.g. downloads and copypasting from the Internet, copying from CD-ROMs etc.), digitization of works in analogue form (e.g. by scanning) and print out of works from digital form. There is nothing in the licences preventing the educational institutions from compiling course packs.
Copied material must be accessed via closed password protected networks, such as an intranet.
Educational institutions as well as private businesses can use copyright protected materiel (except News Papers) in digital presentation tools such as Power Point and Smart Boards.

Types of institutions/sectors licensed
Primary schools, secondary schools, commercial and technical schools, teacher training colleges, folk high schools, music schools, universities, other institutions of higher education, the public administration and governmental departments, municipalities, private enterprises, public and private organisations etc.
DIGITAL LICENCES - Types of works licensed
Works: Literary works, written dramatic works and lyrics (songs).

Subject to the following exceptions:
• Unpublished works
• Isolated pictures, fine arts and illustrations that do not appear in a textual content
• Single use works, published workbooks (intended to be “consumable”) is exempt
• Digital copying of newspapers is exempt
• E-books (no digital copying is permitted if the e-books are on this list:
List of e-books. But you may print them)

The Copydan Writing licenses are subordinate to subscription arrangements and other licence agreements the user have entered into i.e. concerning newspapers or licence agreements concerning electronic periodicals.

New developments / legislation
Directive 2014/26/EU (CRM directive) has been implemented by amending the Danish Copyright Act and by adopting new legislation “The law on collective management of copyright”. The Marrakesh Treaty and directive has been implemented by amending the Danish Copyright Act. The GDPR and the incorporation hereof in Copydan Writing has been a priority for the management and will continue being so in the future.

Copydan Writing continues to enter into licenses on the basis of the general extended collective licensing provision (DCA article 50(2)). The licenses entered are primarily with publishers or organisations as contracting parties wanting to clear authors’ rights to out-of-commerce works/orphan works in order to digitize and make available for the public. Copydan Writing has recently made an effort to make the process of entering into agreements on the basis of article 50(2) more transparent while also simplifying the administrative process.
