Organisation

SAZOR GIZ is the Slovenian reproduction rights organization (RRO). SAZOR was established on June 20th 2003 by three founding members: the Chamber of Commerce and Industry of Slovenia, the Slovenian Authors' Association (ZAMP) and the Slovenian Technical and Scientific Translators' Association. In 2007 SAZOR obtained the licence of the Slovenian Intellectual Property Office (SIPO) to act as a collective management organization dealing with the compulsory colective management of mechanical reproduction rights. Since then SAZOR has been representing and collectively managing the reproduction rights of over 1000 authors (writers, journalists, authors of scientific or educational texts, photographers, illustrators, playwrights) and over 100 publishers (of books, newspapers, magazines, etc.). In terms of the Slovenian book market SAZOR already represents the majority of the market. SAZOR provides support to the right holders and the users, and collects and distributes the remuneration for reprography to the entitled parties. It actively promotes and works to ensure the lawful use of all copyright works.

In 2020, as a result of failed reporting, SAZOR has filed a lawsuit against importers of mobile devices enabling scanning as part of the reprographic usage scheme. The legal procedure is under way.

New Developments Legislation

In addition to the existing Slovenian Copyright Act (ZASP, Zakon o avtorski in sorodnih pravicah) a new act regulating exclusively the Collective Management of Protected Works has been passed in 2016 and enters into force in Fall 2017 (ZKUASP, Zakon o kolektivnem upravljanju avtorske in sorodnih pravic). The law regulates and details the functioning, governance, legal status, statutes and digital requirements of CMOs, assigning inspection authorities to the regulating body (The Slovenian Intellectual Property Office). It also requires that the whole repertoire of the rights holders be listed on the CMO websites. The new law also implements the EU Directive on Collective management of copyright and subsidiary rights (2014/26/EU). CMOs have until October 22, 2017 to adapt and comply with the new regulations which represent a large field of action, demanding expanded knowhow and expertise which also led Sazor to strengthen its Administrative Board with a new permanent member. Autumn 2017 saw the compliance with the new law on CMOs and the adoption of an udapted Statute of the organisation. The new legal package also requires online availability of the represented right holders and their repertoire, so considerable efforts and funds have been invested into the creation of a strong back-office for the registration and management of the represented rights. In 2020, based on demands by SIPO, SAZOR underwent a comprehensive update of its statute and internal acts reflecting further compliance with the exsiting legislation. It is also preparing its database to reflect repartition based on sampling of actual usage of copyrighted material in educational institutions, thus also enabling payments being made to foreign RROs in the future. The implementation of the EU Directive on Copyright in the Digital Single Market is currently under way in Slovenia and SAZOR provided its position to the relevant government bodies in 2020, 2021 and 2022.

New Developments Licensing

In 2016 Sazor has concluded a major licensing agreement that has been in the works for several years. The agreement concerns the Slovenian educational system and involves a joint agreement between Sazor and schools, elementary and high, as well as kindergartens, all under the tutelage of the Slovenian Ministry of Education. A tariff has been agreed upon and a roadmap regarding the monitoring of the reproduction processes in the establishements involved. An important part of Sazor's activites in 2017 was the implementation of the agreement with educational institutions that needed interpretation and a great deal of administration in the first year of remuneration collection. Funds have been successfully collected and will be distributed in 2018 according to the CMO's internal regulations. An awareness campaign for schools and the general public explaining the legal frame and the pros of the agreement is under way in 2018. A detailed analysis of the legal frame and European practices concerning educational usage has been prepared for internal uses and the uses of the Ministry of Education. Special care is also given to the monitoring of actual reprography going on in schools. The findings of the study will set the basis for a new round of tariff negotiations in 2019-20. Another major development in 2017 has been the start of the negotiations regarding reprography in the private sector. There have been extensive presentations of the legal frame and uses in the private sector and a thorough analysis of European practices has been made. A proposal of tariffs is under way based on a comparison of similar tariffs in IFRRO members. Negotiations with the business sector have been ongoing in 2019 and in 2020 and a collective agreement has been signed in 2021. The agreement is under implementation and collections are growing.

New Developments Other

SAZOR was very active in the international arena in 2018 and has organised several conferences and PR campaigns regarding the adoption of the EU DSM Directive in cooperation with IFRRO. MEP Axel Voss was Skype guest at the Ljubljana conference in September and IFRRO Director of European Affairs Catherine Starkie was attended. The event greatly contributed to turning Slovenian public and MEPs opinion in favour of the directive at the plenary vote in the EP. As a follow-up, SAZOR director Luka Novak spoke at the Content for Education Conference organised by IFFRO in the EP in Brussels on September 26, 2018, representing the voice of RROs and presenting the Slovenian school licensing model. Luka Novak also presented the Slovenian model at the IGM in Athens for RROs in development. In 2018 and first quarter 2019 SAZOR was very active in the field of concluding bilateral agreements with RROs. Bilateral agreements were signed with French CFC, Bosnian Original, Polish KOPIPOL and Copyright Polska, US Copyright Clearance Center, British NLA Media Access, Copyrus and KOPINOR. These agreements will not only help strengthen SAZOR's position towards the Slovenian regulator but also present an important position in further licensing negotiations with businesses and public bodies. In 2020-21 SAZOR has signed bilateral agreements with CEDRO and OSDEL. In 2022-23 SAZOR signed representation agreements with CADRA and ABDR.
